• Employer files a petition on behalf of the prospective employee. The application needs to be job specific and needs to mention the exact duties of the position, the dates of employment and other related information.

• The actual wage being paid is compared with the 'prevailing wage'. The employer is required to pay the higher of the two.
• File the Labor Certification Application (LCA) - in which the employer gives information about the company and agrees to certain conditions mentioned therein.
